KRS 338.031(1)(a): The employer did not furnish to his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees, in that: a.On or about 04/09/2007, employees were exposed to the hazard of being struck by flying pieces of die material that were expelled from mechanical power presses located in the Press Department which fatally injured an employee. One feasible and acceptable abatement method, among others, to correct this hazard is to install guards designed to protect the operator from flying material and to provide training on the proper safe use of the equipment.
