Text For Citation: 01 Item/Group: 001 Hazard: CAUGHT
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being stuck-by and caught between the rotating superstructure of a Caterpillar 315C excavator. Among other feasible methods, one feasible and acceptable means of abatement includes but is not limited to barricading the accessible areas within the swing radius of the rotating superstructure of the excavator. A) LOCATION: 752 TURNPIKE ROAD, SHREWSBURY MA TWO WORKERS WHERE OBSERVED EXITING A 14 FT DEEP TRENCH IN WHICH A LADDER WAS USED AS A MEANS OF EXIT. THE TOP OF THE LADDER WAS LOCATED WITHIN THE SWING RADIUS OF THE EXCAVATOR AND EMPLOYEES WERE OBSERVED CLIMBING UP THE LADDER WHILE THE MACHINE WAS BEING ROTATED.
