Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being struck by bullet fragments during firearm testing. a) PRODUCTION FIRING RANGE; ON OR ABOUT JULY 12, 2008 EMPLOYEES WERE EXPOSED TO THE HAZARD OF BEING STRUCK BY REBOUNDING BULLET FRAGMENTS DURING FIREARM TESTING. DESIGN OF THE EXISTING RANGE WAS SUCH THAT "REBOUND" FRAGMENTS, PARTICULARLY DURING CARBINE TESTING WOULD OCCASIONALLY TRAVEL BACK UP THE FIRING TUBES AND STRIKE EMPLOYEES. SEVERAL EMPLOYEES SUSTAINED SERIOUS PENETRATING PUNCTURE WOUND INJURIES AS A RESULT OF BEING STRUCK BY BULLET FRAGMENTS. AMONG OTHER METHODS, AN ACCEPTABLE MEANS OF ABATING THIS HAZARD WOULD BE TO EITHER MODIFY THE EXISTING TRAPS USED WITH HIGH VELOCITY ROUNDS SO THAT FRAGMENTS DO NOT REBOUND BACK UP THE SHOOTING TUBES OR REPLACE THE EXISTING TRAP WITH A TRAP THAT HAS BEEN PROPERLY DESIGNED AND ENGINEERED FOR THE CAPTURE AND RETENTION OF HIGH VELOCITY ROUNDS.Y
