Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to a falling hazard by the improper use of a rough terrain forklift. Among other methods, one feasable and acceptable abatement method to correct the hazard is to comply with requirements set forth in the Safety Standard for Rough Terrain Forklift Trucks ASME/ANSI B56.6-2002 enumerated below: BEAR HILL CONDOMINIUM DEVELOPMENT BRIDGE RD. NORTHAMPTON,MA: (1) AN EMPLOYEE WAS RAISED TO AN ELEVATION OF 17 FEET ON A JOB-MADE PLATFORM (CONSISTING OF 2X4's, 2X6's AND PLYWOOD) WHICH DOES NOT COMPLY WITH THE DESIGN REQUIREMENTS LISTED IN PART III OF THE REFERENCED STANDARD AS REQUIRED BY PARAGRAPH 5.15.1(A) OF THE SAME STANDARD. (2) THE PLATFORM WAS NOT SECURELY ATTACHED TO THE LIFTING CARRIAGE OR THE FORKS,AS REQUIRED BY PARAGRAPH 5.15.(B) (3) REQUIRED RESTRAINING MEANS SUCH AS RAILINGS, CHAINS, CABLE, BODY HARNESSES, ETC. WERE NOT USED AS REQUIRED BY PARAGRAPH 5.15.5(K) OF THE STANDARD. (4) THE PLATFORM WAS NOT LOWERED TO GROUND LEVEL FOR PERSONNEL TO ENTER AND EXIT AS REQUIRED BY PARAGRAPH 5.15.1(W) OF THE STANDARD.
