Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment or a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: a)On or about September 11, 2007, and at times prior, employees working on barricade trucks were not protected from fall and/or struck-by hazards where the guardrail systems were inadequate. The guardrail systems were constructed of a single adjustable rail along the rear platform of the vehicles, and did not consist of a top rail and a midrail. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to design and install guardrail systems that are in accordance with the Best Practice for Cone Setting Operations, as agreed upon by OSHA and the American Traffic Safety Services Association (ATSSA).
