Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falling off of moving equipment that they were riding on: . (a) On or about October 24, 2006, the Kawasaki, rubber tired front end loader, operating in the south bound traffic lane of Highway 41 had two riders on the tractor, one sitting on the engine cowl behind the operator and a second employee that was standing on the access step on the right side of the unit, holding on to the side of the tractor. Among other methods of abatement, one feasible and acceptable abatement method is to correct this hazard is to forbid employees from riding on equipment that does not have suitable seats with seat belts installed.
