Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard being crushed or struck by the arm or the bucket of the 3308 Crawler Excavator: (a) Location - Ludlow Avenue, Wakefield, MA: On or about 11/14/2006, employees were exposed to the hazard of being crushed or struck by the arm or the bucket of a Caterpillar 3308 Crawler Excavator. Among other methods, feasible means of abatement include (1) Instruct employees to stay clear of the swing area when machine is operating as it states in the Caterpillar Operation Manual.
