North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)facility - employees were using Yale Lift Trucks to lift employees 11'9" while standing on pallets so that employees could reach the tops of the shelves where different types of wines are stored. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to follow the guidelines set forth by the operator's manual (see page 28): 1) Use a safety platform secured to the lifting carriage and/or forks with standard guardrailing. 2) There shall be an operator in the control position on the truck. 3) If the personnel on the platform are engaged in order picking, the platform shall have overhead protection from falling objects as indicated necessary by the operating conditions enforce that employees do not get lifted up to elevated surface while standing on the pallets attached to the forks of the powered industrial trucks.ial
