Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: Jobsite: Employees were using a material hoist that was clearly labeled "DO NOT CLIMB" to access a roof approx 18' above the ground. Among others, one feasible and acceptable means of abatement is to follow the safety and usage instructions specidied by the hoist manufacturer and to use another ladder to access the roof.
