Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the roll-over and/or collision of power industrial truck(s): Facility - On or about 12/06/2006 seat belts were not worn by employees operating the Nissan 90 or the Yale F73 forklifts on or adjacent to uneven surfaces, unpaved yards, uneven road edges, and carrying unstable loads. Among other methods, one feasible and acceptable means of abatement would be to require seat belts to be worn while operating forklifts.
