Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling 10 feet into the shaft and to being struck or crushed by the moving stacker. (a)On or about September 11, 2007, worker(s) in the shipping area were exposed to falling into an unprotected stacker shaft and being struck by a moving stacker. Note: Stacker rated capacity was not indicated on stacker. Feasible abatement methods to correct these hazards include but are not limited to: Provide an interlock system that prevents the gate from being opened when the stacker is moving and prevents the gate from opening when the stacker is not at the landing in accordance with ANSI/ASME A17.3a-1986 Safety Code for Existing Elevators and Escalators. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
