North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by and run over by a rail car: a)Rail Yard - Employee from the wash crew assigned as the switch man did not follow the standard operating procedures when moving cars to be washed to ensure that the tracks would be clear; an employee from another crew was struck and run over by the lead car. Reference: PCS Phosphates Standard Operating Procedure : 53.01.00.02.018, page 4, Switching, paragraph 1 : A crew member or switch man shall be positioned on the leading car or engine during all rail movements. If the switch man is using a mobile vehicle to assist the movement, the switch man must be even with or no more than five car lengths ahead of the last car or switch engine to adequately protect its movement.y
