North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Ref:(a) ASME Standard B30.21-1989 (b) ASME Standard B30.16-1981 (a)Processing, Maintenance Shop - - A lever hoist was being used and had not been load tested.
