Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and impact hazards of operating vehicles without the use of restraint systems: a)Pacific Rail Services & 585 West 53rd Place, Denver, CO: On or before April 19, 2007, the employer did not ensure that employees operating terminal tractors to include but not limited to the Ottawa/Kalmar Model 30 were protected from serious injury/death while driving these vehicles in that the employer did not require the use of the restraint systems that were provided in these vehicles. Among other methods, one feasible and acceptable method to correct the hazard is to follow; the requirements of the American Society of Mechanical Engineers ASME B56.9- 1992, paragraph 5.1.4, and Kalmar Industries Ottawa terminal tractor model 30 operator's manual page 15 (seat belt use), and Pacific Rail Services Operating and Safety Procedures page 23 (seat belt use).
