Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not meet the operator responsibility to operate the rough terrain forklift safely: (a)Superior Sandblasting Inc. at 1795 Great Western Dr., Longmont, CO 80501: The employer, as the forklift operator, did not fulfill his responsibility to operate the forklift safely in that he was not familiar with, nor did he read, the operator's manual for the Lull model 824 rough terrain forklift. This condition exposed the employee to a struck by hazard. (b)Superior Sandblasting Inc. at 1795 Great Western Dr., Longmont, CO 80501: The employer did not ensure employees were kept from working under the elevated portions of the rough terrain forklift in that an employee was permitted to work under the elevated forks as the "tank welder" was lifted in order to turn it. This condition exposed the employee to a struck by hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: Read and follow the safe operating instructions in the Operators and Safety Manual for the Lull 824 rough terrain fork lift. Among other methods, one feasible and acceptable abatement method to correct this hazard is to read and become familiar with the Operators and Safety Manual for the Lull 824 rough terrain fork lift as required in paragraph 6.1.4 of ASME B56.6-1992, The American Society of Mechanical Engineers - An American National Standard - Safety Standard for Rough Terrain Forklift Trucks; "Before operating any rough terrain forklift truck, truck operators shall have read and be familiar with the operator's manual for the particular truck being operated; they shall also abide by the safety rules and practices in paras. 6.1, 6.2, 6.3k 6.4, and 6.5." Read and follow ASME B56.6-1992, The American Society of Mechanical Engineers - An American National Standard - Safety Standard for Rough Terrain Forklift Trucks paragraph Section 6.2.7 "Do not allow anyone to stand or pass under the elevated portions of any rough terrain forklift truck, whether empty or loaded".
