Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by moving vehicle hazards: (a)Easy Street Crane Service, Inc. at 4 mi past Logan's Wash Rd off Cty Rd 204, Parachute, CO 81635: On or before 11/7/06, the employer did not ensure that employees were adequately trained to chain up the water trucks, and that employees were trained in the proper use of the brake system. In the process of chaining up, an employee failed to engage the truck parking brake. As a result, the employee was fatally injured when the truck rolled over him. Condition exposed employees to struck by moving vehicle hazards. Abatement Note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter"). Among other methods, one feasible and acceptable abatement method is referenced in the National Highway Traffic Safety Administration, Department of Transportation 49 CFR 393.41(b), "The parking brake system shall at all times be capable of being applied in conformance with the requirements of paragraph (a) of this section by either the driver's muscular effort, or by spring action, or by other energy, provided , that if such other energy is depended on for the application of the parking brake, then an accumulation of such energy shall be isolated from any common source and used exclusively for the operation of the parking brake."
