Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: On or about 9/21/07, the exposing employer, A-4 Enterprises, Inc., did not ensure that employees operating the Caterpillar CS 323-C Vibratory Soil Compactor were utilizing seat belts. The employees who were operating the equipment without utilizing the seat belt that was available on the equipment, were exposed to a crushing hazard. Abatement Note: Among other methods, one feasible and acceptable abatement method can be found in the Operators Manual under the Safety Section, which instructs operators: A seat belt should be worn at all times during machine operation to prevent serious injury or death in the event of an accident or machine overturn.
