North Carolina Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)yard area - being caught between the forklift's frame and the ground in the event of the vehicle was upset or turned over. The operator was not wearing a seatbelt while operating the Yale forklift truck serial number 5021352-03. Abatement Note: One feasible and acceptable abatement method to correct the hazard was to install a seatbelt and require the operator to wear the installed seatbelt while operating the forklift.
