Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At this facility, an employee was exposed to crushing injuries due to a potential forklift tip over while the Toyota, Model 4FGL10, Serial Number FGL18-15533, Industrial Forklift was used to carry shingles and lumber without the use of a seat belt. One feasible and useful abatement method is to have the forklift retrofitted with a seat and seat belt under the manufacturer's retrofit program, establish a policy that requires the use of seat belts, communicate the policy to employees, and enforce the use of the seat belts.e
