Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about November 8, 2006, a condition existed at the processing plant in Van Buren, Arkansas, in that employees walking in the loading dock area after dark were not easily visible and were subject to potential risk of being struck by shuttle trucks operating in the area. One feasible and effective method of abating this condition is to provide high visibility vests to employees working in this area around shuttle truck traffic.
