Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed the hazard of falling from an elevation and/or being crushed by the weight of the truck: On or about October 16, 2006, and at times prior and after thereto, a Nissan powered industrial truck, Serial No. 9C2206, was being used to horizontally pull/drag loads by attaching chains to the backrest and personnel platform, exposing the truck operator and any bystanders to the hazards of being crushed or struck by the truck in the event of a tip-over, and the employee riding in the platform to the hazards of being ejected from the platform and a fall of approximately 28 feet. Among other methods, one feasible and acceptable method of abatement would be to ensure that loads are only lifted vertically and never dragged horizontally as required by ANSI/ITSDF B56.1-2005, Section 5.4.5(b).5,
