Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being struck by: On or about January 22, 2007 employees working at the maintenance yard were exposed to the hazard of being struck by equipment and vehicles. ABATEMENT NOTE: Among other methods,one feasible and acceptable abatement method is to: Provide employees with highly visible traffic vests and a barricade that surround the work area, to notify drivers of the presence of workers or utilize a flag-person who wears high visibility traffic vest and uses a red flag to alert drivers of the presence of workers on the traveling surface.
