Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load on the Grove Mobile Hydraulic Cranes. The employer allowed his employees to operate the following hydraulic cranes throughout the shipyard without conducting and documenting the required periodic inspections of the equipment. This condition exposed the employees to a struck-by hazard. a) Grove wheel mounted crane with telescoping boom, Model RT 58 B, serial number 40814. b) Grove wheel mounted crane with telescoping boom, Model RT 58 C, serial number 42204. c) Manitowoc hydraulic Crawler Crane Model 3000, serial number 30194. d) Manitowoc hydraulic Crawler Crane Model 4000-W, serial number 40034. e) Manitowoc hydraulic Crawler Crane Model 4000, serial number 40122. Among other methods, one feasible and acceptable method to correct the hazard would be to follow the prescribed maintenance schedule provided by the manufacturer. DISCLAIMER 1) You are not limited to the abatement method suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selecting and carrying out an appropriate method of abatement.
