Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from the potential dust explosion hazard that could have resulted from, or been exacerbated by the failure to locate dust collectors that collect combustible/explosive dust outside of the building and by the failure to provide barriers or other means of protection of personnel: a) Decoil Area: Hammond DusKolector (model DK-1055) which collects dust that was potentially explosive was located inside the building and no barrier or other means of protection were provided for personnel, as observed on or about August 8, 2007. b) 18 Gauge Finishing Cell, Rework Area: Aget Dustkop (model 20C31) dust collectors (4) which collect dust that was potentially explosive were located inside the building and no barriers or other means of protection were provided for personnel, as observed on or about August 8, 2007. c) Finishing Area: Grizzly (model G1028z/G1029) dust collectors (4) which collect dust that was potentially explosive were located inside the building and no barriers or other means of protection were provided for personnel. The dust collectors were designed only for the collection of wood dust, as observed on or about August 8, 2007. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow NFPA 484 Standard for Combustible Metals, including but not limited to: Relocate dry-type dust collectors outside of the building per NFPA 484, section 12.2.1.4. Provide dry -type collectors with barriers or other means for protection of personnel per NFPA 484, section 12.2.1.5.
