Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential collapse of a silage pile 12-13 feet in height. a.) Bunker Silo - Employees collected samples while standing at the face of a 12-13 foot high silage pile, February 6, 2007. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED Among other methods, one feasible and acceptable method to correct this hazard is: a.) Develop and implement procedures that establish restricted areas at the face of all bunker silos and prohibit employees from entrance to those restricted areas. b.) Establish and implement safe work practices regarding taking feed samples while working with equipment operators, establish proper silage sampling techniques (don't enter the restricted zone near the pile face), and request equipment operators to bring samples to employees outside the restricted area.
