Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of being struck while working in close proximity to a backhoe. At the work site, 1920 State Hwy. 194, Plainview, Texas. Prowaste Inc. employees were required to work in a blatantly hazardous situation when they were directed to use a backhoe to drive hold-down stakes for a trailer being installed at this facility while another employee held the stake. Among other methods one method would have been to use a sledge hammer or a hammer drill to drive in the stakes.
