Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling while leaving the platform of a scissor lift without fall protection: On or about 03/28/07, one employee was observed climbing out of a fully extended scissor lift basket that was positioned to access an elevated working/walking surface at approximately 19 feet from the ground. Among other methods of abatement, one feasible and acceptable method to correct this hazard is for the employer to ensure employees follow the manufacturer's equipment operational and safety manual.
