Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to a hazard of being struck by: AVD 5(a)(1) High Visibility Apparel On or about 09/06/06, at a traffic intersection, employees who lacked high visibility apparel were exposed to the hazards of being struck and run over by moving vehicles while installing a draining system near the road. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to provide high visibility apparel to employees.
