Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that were exposed to: the struck-by hazards associated with moving vehicles in a low visibility area: a. On or about January 17, 2007, at the above addressed worksite an employee operated a front- end loader in an open yard area east of building D, at night, that had an average illumination level of approximately 0.05 foot-candles. The level of illumination was approximately 1/40th of the 2 foot-candle requirement for all areas were there is a high degree of hazard and a low level of activity. The average level of illumination was determined for an area of approximately 28,900 square feet to the east of building D. Other employees in the open yard area were exposed to struck-by hazards associated with moving vehicles. A feasible means of abatement would be to install lights to provide a minimum of 2.0 foot- candles in all areas were there is a high degree of hazard and a low level of activity, as recommended by Section 14.2 of the ANSI/IESNA RP-7-01. In addition, the worksite's dusty conditions further reduced the operator's ability to see and may require an illuminance level above the absolute minimum of 2.0 foot-candles set for safety in ANSI/IESNA RP-7-01.
