Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries and/or death from falls from moving equipment: On or about July 25, 2006, at the above located work place, an employee was riding on the outside arms of a Case 90XT Bobcat while traveling on the street. The employee was exposed to fall and crushing hazards. A feasible and acceptable method, among others, to correct this hazard would be to follow the Association of Equipment Manufacturers Institute (AEM) safety manual of users and operators of skid steer loaders and/or the Operator's Manual which does not permit riders.
