Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to possible struck by hazards: On or about 05/30/07, the employer failed to ensure that employees working/walking in the street that was being worked on were wearing reflective safety vests at the time. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to ensure that all employees are instructed to wear reflective vests while walking/working in these work zones.
