KRS 338.031(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.Employees were exposed to the companys Reach All type aerial lift collapsing and falling with employees aboard from heights up to 52 feet and employees on the ground were exposed to being struck by the falling lift components. Among other methods, one feasible and acceptable abatement method to correct this hazard is to properly maintain the lift and to establish and enforce an adequate inspection procedure such as that stipulated by ANSI A92.2-1969 for Periodic Inspection and Tests including loading, stability, visual inspection, and insulation, performed at regular intervals.
