Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Chamorro Village Sewer: An employee was operating a John Deere Backhoe, Model- 410D, to hoist a concrete cover to a sewer. Modified metal rods, nuts and bolts were used as pins for the backhoe shovel instead of the pins originally provided by the manufacturer. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD IS: 1.To follow the Association of Equipment Manufacturers (AEM) "Safety Manual Operating and Maintenance Personnel" which requires that damaged and missing parts are repaired, and 2.To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, and 3.To train the operators and maintenance personnel to inspect equipment for defects and complete service repairs before equipment is placed back in service.t
