North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by pieces of exploding blank ammunition/shots used to activate powder activated tools, re: MSDS #101 dated 06/06/00: a)site-employees were exposed to the hazard of misfired .22 cal. blank cartridges used in powder actuated tools that were left laying around the job site. (re: MSDS) One feasible method of abatement is to follow the instructions in the MSDS.
