North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a)facility, mold/pour area - where an employee was working from a wooden box that was elevated by the forks of a Kalmar forklift approximately 8' above the floor in order to hang a plastic sheet in the opening to the area. The box was not an approved work platform and was not secured to the carriage or forks (reference ASME B56.1-2004, Safety Standard for Low Lift and High Lift Trucks). The loading limits of the box were not known. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO USE A PLATFORM WHOSE DESIGN IS IN ACCORDANCE WITH ASME B56.1. THE PLATFORM MUST HAVE AN ATTACHMENT MEANS THAT ARE APPLIED AND THE PLATFORM IS SECURELY ATTACHED TO THE LIFTING CARRIAGE OR FORKS, THE LIFTING CARRIAGE OR FORKS MUST BE SECURED TO PREVENT THEM FROM PIVOTING UPWARD, AND THE AREA MUST BE MARKED WITH CONES OR OTHER DEVICES TO WARN OF WORK BY ELEVATED PERSONNEL.
