North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Plant 2, packaging - where employees were allowed to use a 1 1/2 ton jib crane to lift machinery and the rail was damaged and had not been load rated. The crane had never been inspected. Ref: ASME B30.16-1981 Section 16-2.1(b)(2); Table 2 One feasible and acceptable means of abatement, among others, to correct this hazard would be to conduct inspections as specified in ASME B30.16-1981.
