Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by a truck: a.On or about August 25, 2007, on the southwest milling pile, employees were exposed to being crushed by the truck when it was dumping its loads of milling material on an unleveled surface. One feasible and acceptable means of abatement is to follow the manufacturer's guide lines that state: "The vehicle MUST BE on a level and compacted driving surface before dumping." "DO NOT dump on ground that has been recently excavated or filled without being properly compacted." ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
