Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling trees/ branches while pushing over trees with an exavator: a.On or about May 4, 2007, the Caterpillar 320CL excavator that was used to fell trees did not have an attachment for the excavator specifically designed to fell trees. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use equipment specifically designed for tree felling operations. Another means of abatement would be to manually fell the trees. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED.TION
