Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards when working from a waste basket attached to the fors of an industrial truck: a.On or about October 26, 2006, parking lot, two employees were changing a light bulb from a waste basket that was attached to the forks of a Lull, industrial Truck. Employees were exposed to a 15 feet fall hazard. Among other methods, one feasible and acceptable method to correct this hazard is to ensure the safe use of an aerial lift to access the light bulb. ABATEMENT CERTIFICATION IS NOT REQUIRED.
