40.1-51.1(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: At this site (car wash) on 4/6/2006 an accident occurred involving an employee who was performing car cleaning operations. An employee was driving a van out of the car wash and pressed the excelorator/gas pedal and hit another car while an employee was cleaning the interior of the car. As a result of the accident the employee cleaning the interior of the car sustained injuries. The employee that was driving the van did not have a motor vehicle operators license to drive the motor vehicle. Management had knowledge that the employee driving the van did not have a motor vehicle operators license. Employee(s) exposed to struck-by hazard(s). " ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS TO CORRECT THIS HAZARD IS TO HAVE EMPLOYEES WHO ARE RESPONSIBLE FOR DRIVING THE CARS OUT OF THE CARWASH IS TO HAVE THE EMPLOYEES LICENSED MOTOR VEHICLE OPERATORS."
