Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and burn hazards while grinding on molten and solid sulfur pipes: (A)Sulfur Unloading and Other Plant Locations: On or about August 29, 2007 and at times prior thereto, a means of fire protection was not utilized while employees were grinding on pipes containing solid and molten sulfur. ABATEMENT NOTE: Amongst other methods, one feasible and acceptable abatement method to correct this hazard is to provide a fire watch as described in National Fire Protection Association (NFPA) 51B, Fire Prevention During Welding, Cutting and Other Hot Work or only permit activities involving open flames, such as cutting or welding, heat, or hand or power tools, only after all operations have ceased and all sulfur has been removed from the vicinity, protected in tight noncombustible containers, or sufficiently wet with water to prevent ignition as described in NFPA 655-8, Prevention of Sulfur Fires and Explosions. Note: Abatement certification and supporting documentation are required for this item.
