Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees engaged in residential refuse, yard waste, and recyclable materials collection were exposed to the hazard of falling from and/or being struck by the mobile refuse collection truck being used or struck by another private vehicle traveling the same roadway: (a)On or about September 20, 2006, and at times prior to thereto, collectors were riding on running boards and side steps of the collection truck cabs (including but not limited to CR1, R4 and R6) near the front of the trucks. These steps were not designed to be used as "riding steps" for the following reasons: a) the running boards were only 7 inches deep; b) had only 98 square inches of surface area; and c) were located in front of the rear axle of the collection truck. (b)On or about September 20, 2006, and at times prior to thereto, collectors traveling on riding steps and running boards of recycling, refuse, and yard- waste trucks (including but not limited to Y4, CR1 and R6) did not have both hands on the hand-holds and both feet on the steps. (c)On or about September 20, 2006, and at times prior to thereto, collectors traveled on riding steps and running boards of recycling, refuse, and yard- waste trucks (including but not limited to Y5, Y4, and R6) while the trucks traveled at speeds up to approximately 25 to 35 mph. (d)On or about September 20, 2006, and at times prior to thereto, collectors traveled on riding steps and running boards of recycling, refuse, and yard- waste trucks (including but not limited to Y5) while the trucks traveled in reverse. (e)On or about September 20, 2006, and at times prior to thereto, collectors traveling on riding steps and running boards of recycling, refuse, and yard- waste trucks (including but not limited to Y4 and R6) routinely mounted and dismounted the steps while the collection trucks were in motion. (f)On or about September 20, 2006, and at times prior to thereto, a collector used the stand-up position in truck CR-1 while in transit along Bryden Canyon Road to the transfer station/office and did not have the doors latched, use the restraining devices, and traveled at speeds approximately 35 to 45 mph. FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THESE HAZARDS are to comply with the safety standards in the Environmental Industry Associations' ANSI Z245.1 - 1999: for Equipment Technology and Operations for Wastes and Recyclable Materials - Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment Safety Requirements, including, but not limited to:(a)Training and supervising employees under paragraph 6.1; (b)Riding only in the cab, except where designated riding steps are provided, and not anywhere else on the vehicle; (c)Keeping all cab doors closed and latched during transit; (d)Remaining in driving or riding position(s) during collection activities until the vehicle has come to a complete stop and the brakes are set; (e)Wearing seat belts at all times when the vehicle is in transit, except as necessary during collection; (f)Ensuring that no persons ride on steps when the vehicle is exceeding 10 mph, operating in reverse, or when the distance traveled exceeds 0.2 miles; (g)Ensuring that no person mounts or dismounts riding steps unless the vehicle is completely stopped; (h)Ride facing the side of the vehicle with both hands on the handholds and both feet securely positioned on the steps; (i)Riding steps shall have hand hold(s), placed so that a rider who is positioned on the step facing the side of the body, shall be able to attain four point contact with the vehicle, using both hands and bot feet at approximately shoulder width; (j)Riding steps shall have a depth of at least 8 inches and provide a minimum of 220 square inches of surface area; (k)Riding steps shall be located behind the rearmost axle of the vehicle, but not beyond the rearmost structural portion of the vehicle. (l)Limiting speed in the stand-up position to a maximum of 20 mph; (m)When in transit, while driving at the secondary position, ensure employees use restraining devices; ABATEMENT NOTE: Abatement certification and supporting documentation is necessary for this item.
