Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or crushed by heavy equipment (Bulldozers and Trackhoe machines) when the machine is operating and during repairs: Location: Recycling transfer-station facility located at 151 Anthony St, Brooklyn, N.Y. On or about 04/24/06. a)Jack-stands did not comply with the manufacturers specifications. Shop made jack stands were made from a piece of pipe welded to a base plate and were used in the bulldozer repair shop to support the bulldozer 18 inches above the floor. Employees can be injured if the jack-stands fail to hold the weight. b)A blocking bar was not used to support the bulldozer cab when the cab was raised up for repairs. The cab was supported only by a chain and can fall onto an employee if the chain fails or comes loose. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Use equipment (jack-stands and blocking devices) suggested by the manufacturer (Caterpillar) or designed by and approved by an engineer. Develop and maintain a standard operating procedure(s) for the maintenance of the heavy equipment. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19
