Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that proper procedures were followed during tree trimming, as follows: a.At the Pecos Park Coach Club, space #56, an inspection was not conducted to determine whether an electrical hazard existed prior to start of the work. An employee received an electrical shock while attempting to remove the top of a tree and branches to the ground below him when a portion of the tree touched a 7.2kV power line. Employee #1 was taken to a local hospital and was hospitalized and treated for burns to the left side of his forehead, back of his left shoulder and upper left arm, a small burn to the inside of his right foot and a burn/hole in his right calf. Reference: ANSI Z133.1-1994, for Tree Care Operations - Pruning, Trimming, Repairing, Maintaining, and Removing Trees, and Cutting Brush - Safety Requirements, paragraph 5.2.1, an inspection shall be made by a qualified tree worker to determine whether an electrical hazard exists before climbing, or otherwise entering, or performing any work in the tree. b.At the Pecos Park Coach Club, space #56, a job briefing and work procedures were not conducted prior to employees beginning work of trimming an elm tree. Interviews revealed that employees arrived at the site, remove equipment from vehicle(s), put on personal protective equipment and started working. Reference: ANSI Z133.1-1994, for Tree Care Operations - Pruning, Trimming, Repairing, Maintaining, and Removing Trees, and Cutting Brush - Safety Requirements, paragraph 4.1.2, a job briefing, work procedure, and assignment shall be worked out carefully before any tree job is begun. c.Employees were not aware of the distance requirements when working near a 7.2kV electrical powerline. Interviews revealed that two employees believed that the distance requirement was six feet. Reference: ANSI Z133.1-1994, for Tree Care Operations - Pruning, Trimming, Repairing, Maintaining, and Removing Trees, and Cutting Brush - Safety Requirements, paragraph 5.2.5, all other tree workers shall maintain a minimum clearance of 10 feet from energized conductors rated 50kV phase-to-phase or less. One feasible means of abatement would be to follow the requirements as stated in ANSI Z133.1-1994.
