T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On March 2, 2006 the Fayetteville Public Utility took inadequate precautions to prevent an accidental ignition of a residential gas pilot that exploded and fatally injured an employee. One feasible abatement method, among others includes: Conducting a detailed personal protective equipment assessment to ensure the best possible protection while working in a potential hazardous atmosphere.
