Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling lumber: a)Establishment: The straps bundling the Nine 3 inch by 12 inch by 20 foot long wooden planks, were cut before the bundle was lowered to the ground, this caused the un-strapped lumber to fall from the truck and struck the employee. or about 4/17/06. Abatement Note One feasible and acceptable method, among others, to correct this hazard is; Follow the company's own procedure by lowering the bundled material to the floor and then cut the straps holding the lumber. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
