Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:04/26/06 Location:Collection Route TRZ-13 Equipment:Labrie Maxi-Mizer Recycling Truck, MD Tag: #39L 857; VIN: # IHTSDAAN7VH473287 Condition:An employee operated a Labrie recycling truck, with dual operating positions, from the right-hand side driving position, while standing and not engaged in door-to-door collection of recyclable refuse, and while exceeding 20 mph. Among other methods, one feasible and acceptable means of abatement is to develop, implement, and enforce safe operating rules for refuse collection vehicles to include, but not limit to, using the right-hand side driving position only when engaged in door-to-door refuse collection, and not exceeding 20 mph in accordance with the manufacturer's safety manual, and American National Standards Institute ANSI Z245.1-1992, Mobile Refuse Collection and Compaction Equipment Safety Requirements. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
