Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and/or amputation hazards from unintended activation: a) Fabrication Area, Wyson Shear - On or about June 29, 2007 the foot control for the Wyson Shear P32-1095 was not guarded. b) Fabrication Area, Chicago Dreis & Krump Press Brake - On or about June 29, 2007 the foot treadle on the Dreis & Krump Press Brake L-13411 was not guarded as the previous guard had broken off. c) Fabrication Area, Niagara Press Brake - On or about June 29, 2007 the foot treadle on the Niagara Press Brake was not guarded. Among other methods, one feasible and acceptable abatement method to correct the hazard is to guard the foot treadle or control in accordance to the requirements of ANSI B11.4 1983 for Safety Requirements for the Construction, Care and use of Shears and ANSI B11.3 1982 Safety Requirements for the Construction, Care and Use of Press Brakes. No abatement certification or documentation required.
