Text For Citation: 01 Item/Group: 001 Hazard: EXPLOSION
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of an exploding water tank during pneumatic leak testing. a) The employer did not comply with the manufacturer's specifications applicable to an Oshkosh S-Series concrete mixer truck in that an empty 200 gallon water tank was repaired and pressurized with air on or about December 28, 2006. Among other methods, one feasible method to abate this hazard is to follow warnings from the tank manufacturer, McNeilus Truck, which states that welding or repairing may weaken the water tank causing it to explode; if tank is damaged or worn it should be replaced with new equipment. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.tives
