Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.Employees operating a JLG scissors lift were not trained thoroughly on the operation of the lift and its limitations, including pertinent safety measures and warnings, on or about February 11, 2006. An employee attempted to use the lift as a crane to erect a fallen tree, which then shifted during the lift to the side and pulled the scissors lift over, severely injuring the employee. Abatement Note(s): Feasible means of abatement include, but may not be limited to, the following: 1. Establish and implement a formal training program which follows the manufacturer's operating instructions: This includes the safety measures and warnings outlined by the manufacturer. Training must be in the language that employees can fully understand. 2. Document all training as required by the ANSI/SIA A92.6-1999 and the JLG operating manual. 3. Ensure employees have a copy of the manufacturer's operating manual on the scissors lift. 4. Establish and implement unannounced safety audits to ensure all operators are following the established safe practices. 5. Establish a progressive disciplinary policy for employees who fail to follow established safe work practices.
